This Privacy Policy explains how Merchard, LLC, doing business as Olideck (“Olideck,” “Merchard,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information in connection with the Olideck website, business profile pages, contact forms, invoicing functionality, payment integrations, and related services collectively referred to as the “Service.”

1. Scope of This Privacy Policy

This Privacy Policy applies to personal information we process about:

  • Individuals who create or maintain an Olideck account
  • Visitors to Olideck and Olideck-hosted profile pages
  • Individuals who submit information through an Olideck contact form
  • Customers or prospective customers whose information is entered into Olideck by an account holder for invoicing or related purposes
  • Individuals who receive or view an Olideck invoice
  • Individuals who interact with payment functionality made available through Olideck
  • Individuals who apply to or participate in the Olideck Partner Program, and users referred through that program
  • Individuals who contact us for support or otherwise communicate with us

2. Information We Collect

The information we collect depends on how you interact with Olideck.

2A. Account Information

When you create or maintain an Olideck account, we may collect information such as:

  • Your email address
  • Your profile or business name
  • Account identifiers
  • Authentication and account-security information
  • Account settings
  • Information associated with your use of the Service

2B. Profile and Business Information

When you create an Olideck profile, we may collect information you choose to provide, including:

  • Profile images
  • Business names
  • Personal or professional names
  • Business descriptions
  • “About” information
  • Service descriptions
  • Service pricing
  • Business details
  • Other information you choose to publish through your profile

Certain information you submit is intended to appear publicly on your Olideck profile.

You should not include information on your public profile that you do not want publicly accessible.

2C. Contact Form Information

Visitors may use contact forms on Olideck profiles to communicate with profile owners.

When a visitor submits a contact form, we may collect:

  • The visitor’s name
  • The visitor’s email address
  • The message submitted by the visitor
  • The profile to which the submission was directed
  • Submission date and time
  • Related technical or security information

We use this information primarily to transmit the inquiry to the applicable Olideck profile owner.

The profile owner will receive the information submitted through the contact form and may independently retain, use, respond to, or otherwise process that information.

Olideck does not control how a profile owner uses information after receiving it.

2D. Invoice Information

When an Olideck account holder creates an invoice, we may collect and process information such as:

  • The customer’s email address
  • Invoice description
  • Invoice amount
  • Invoice identifier
  • Invoice creation date
  • Invoice status
  • Payment status
  • Transaction-related identifiers
  • Other information necessary to create, deliver, display, or track the invoice

The Olideck account holder supplying this information is responsible for ensuring that they are authorized to provide and use their customer’s information for these purposes.

2E. Stripe and Payment Information

Payment processing is provided by Stripe and its affiliates.

When payment functionality is used, Stripe may directly collect payment information, identity information, financial information, billing information, bank information, payment card information, and other information necessary to provide its services.

When payments are completed through Stripe-hosted or Stripe-controlled payment interfaces, Olideck generally does not receive or store complete payment card numbers or card security codes.

We may receive certain information from Stripe necessary to operate Olideck payment functionality, such as:

  • Stripe account identifiers
  • Connected-account status
  • Payment status
  • Transaction identifiers
  • Transaction amounts
  • Refund or dispute status
  • Other payment-related metadata

Stripe processes personal information according to its own agreements and privacy practices.

2F. Partner Program Information

If you apply to or participate in the Olideck Partner Program, we collect your application, agreement acceptance and version, referral-link identifier, membership status, commission rate, and information needed to set up and track Stripe transfers and payouts.

When someone visits a partner referral link, we count the visit by partner and day. This referral-visit count does not store a visitor's IP address, fingerprint, or individual identity. If the visitor requests a sign-in email while a valid referral cookie is present, we may store an email-bound signup intent with the referring partner and referral-click time. For a genuinely new account, we record the referring partner, signup time, and commission eligibility period.

We also keep records needed to calculate and review referral commissions, including qualifying payment amounts, platform fees, refunds, disputes, adjustments, transfers, and related Stripe identifiers. A partner dashboard shows referral activity and earnings information associated with that partner; Olideck administrators can review more detailed referral and accounting records.

2G. Device, Usage, and Technical Information

When you access the Service, we or our service providers may automatically collect certain technical information, including:

  • IP address
  • Browser type and version
  • Device type
  • Operating system
  • Pages or features accessed
  • Referring information
  • Date and time of access
  • Diagnostic information
  • Server logs
  • Security events
  • Other information about interaction with the Service

We use this information to operate, secure, troubleshoot, monitor, and improve the Service.

3. Information We Receive From Other Sources

We may receive information about you from other sources, including:

  • Stripe
  • Olideck account holders
  • Infrastructure and security providers
  • Email-delivery providers
  • Payment networks and financial institutions
  • Fraud-prevention providers
  • Other service providers used to operate Olideck

For example, an Olideck account holder may provide a customer’s email address to us when creating an invoice.

4. How We Use Personal Information

We may use personal information to:

  • Create and administer Olideck accounts
  • Authenticate users and maintain account security
  • Create and host Olideck profiles
  • Display information users choose to make public
  • Generate visual elements of Olideck profiles from uploaded images
  • Provide contact-form functionality
  • Deliver contact submissions to profile owners
  • Create, send, display, manage, and track invoices
  • Integrate with Stripe and provide payment functionality
  • Calculate or facilitate Olideck platform fees
  • Attribute eligible Partner Program signups, calculate commissions, review refunds and disputes, and administer partner transfers
  • Display transaction and invoice statuses
  • Provide customer support
  • Communicate about accounts, transactions, invoices, security, and the Service
  • Maintain and improve the Service
  • Diagnose technical problems
  • Prevent spam, fraud, abuse, and unauthorized activity
  • Enforce our Terms of Service and other policies
  • Protect Olideck, our users, customers, and third parties
  • Comply with legal, tax, accounting, regulatory, and law-enforcement obligations
  • Establish, exercise, or defend legal claims
  • Conduct internal business operations
  • Perform other purposes disclosed to you when information is collected

Where required by applicable law, we rely on an appropriate legal basis for processing personal information.

5. Public Information

Olideck is designed to provide users with publicly accessible business or professional profiles.

Information that you choose to publish on an Olideck profile may be accessible to anyone on the internet and may include:

  • Your profile image
  • Profile or business name
  • Business description
  • Service descriptions
  • Pricing
  • Other information you elect to make public

5. Public Information, continued

Public information may be viewed, copied, indexed, cached, or otherwise processed by search engines, browsers, internet archival services, or other third parties outside our control.

Removing information from Olideck does not guarantee that copies previously obtained by third parties will be deleted.

6. Contact Form Data and the Profile Owner

Olideck contact forms are designed to allow visitors to contact a profile owner without requiring the profile owner to publicly display their personal email address.

When you submit a contact form, the information you provide is disclosed to the owner of the applicable Olideck profile.

The profile owner is an independent person or business and is responsible for how they use information after receiving it.

For contact submissions, Olideck may process personal information on behalf of the profile owner for purposes such as receiving, transmitting, securing, and troubleshooting the submission.

If you have questions about how a particular profile owner uses information that you submitted to them, you should contact that profile owner directly.

7. Customer and Invoice Data Provided by Olideck Users

Olideck users may provide personal information about their own customers or prospective customers when using features such as invoicing.

In these circumstances, Olideck may process that information on behalf of the account holder to provide the requested functionality.

Account holders are responsible for:

  • Having an appropriate legal basis or authorization to provide customer information to Olideck
  • Providing any notices required by law
  • Complying with applicable privacy, marketing, and data-protection laws
  • Responding to their customers regarding the account holder’s independent use of customer information

Olideck is not responsible for an account holder’s independent privacy practices.

8. How We Disclose Personal Information

We may disclose personal information in the following circumstances.

8A. Service Providers

We use companies that provide infrastructure, security, communications, email, payment, hosting, and other services necessary to operate Olideck.

These providers may process personal information as necessary to perform services for us.

Current significant providers include:

  • Render: Provides hosting, infrastructure, databases, and related technical services
  • Cloudflare: Provides network, security, performance, and related infrastructure services
  • Resend: Provides transactional email delivery and related communication services
  • Stripe: Provides payment processing, connected-account services, payment infrastructure, fraud prevention, and related financial services

8A. Service Providers, continued

These providers may process information according to their own agreements, privacy policies, and applicable data-processing arrangements.

We may add, replace, or change service providers as the Service evolves.

8B. Olideck Profile Owners

When you submit a contact form, we disclose the information contained in the submission to the owner of the profile you contacted.

8C. Invoice Recipients

When an Olideck user creates an invoice, information associated with the invoice may be disclosed to the intended recipient.

8D. Stripe and Financial Services Providers

Information necessary to enable payments, manage transactions, calculate fees, prevent fraud, or comply with financial regulations may be disclosed to Stripe and related payment participants.

For Partner Program payouts, we may provide Stripe with partner account and payee information needed for connected-account onboarding, verification, transfers, and related financial services. Stripe may collect additional identity, tax, and bank information directly under its own terms and privacy practices.

8E. Legal and Safety Reasons

We may disclose information if we reasonably believe disclosure is necessary to:

  • Comply with applicable law or legal process
  • Respond to lawful government or law-enforcement requests
  • Enforce our agreements or policies
  • Investigate fraud, security incidents, or unlawful activity
  • Protect the rights, property, or safety of Merchard, LLC, our users, customers, or others
  • Establish, exercise, or defend legal claims

8F. Business Transactions

If Merchard, LLC is involved in a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, change of control, or similar transaction, personal information may be disclosed or transferred as part of that transaction.

8G. With Your Direction or Consent

We may disclose information when you direct us to do so, consent to the disclosure, or intentionally use a feature that requires disclosure.

9. Sale of Personal Information and Targeted Advertising

Olideck does not sell personal information for monetary compensation.

Olideck also does not currently share personal information for cross-context behavioral advertising or process personal information for targeted advertising as those terms are defined under applicable U.S. state privacy laws.

We do not operate an advertising marketplace or sell contact-form submissions, customer lists, invoice recipient information, or profile-owner information to advertisers or data brokers.

If our practices materially change, we will update this Privacy Policy and provide any choices or notices required by applicable law.

10. Cookies and Similar Technologies

Olideck and our service providers may use cookies, local storage, and similar technologies where necessary to:

  • Authenticate users
  • Maintain sessions
  • Remember preferences
  • Secure the Service
  • Prevent fraud or abuse
  • Maintain network functionality
  • Troubleshoot errors
  • Understand basic Service performance and usage

When you visit an active partner referral link, Olideck may set a signed, HTTP-only referral cookie that lasts up to 30 days. It records the first valid partner link and click time in that period so we can attribute a new account if you request a sign-in email and complete signup. Later partner links do not replace a valid first-link cookie. Clearing or blocking the cookie can prevent attribution.

Some third-party services integrated into Olideck may use their own cookies or similar technologies.

Where required by applicable law, we will provide appropriate notice or obtain consent before using non-essential cookies or similar technologies.

11. Sensitive Personal Information

Olideck is not designed for the collection or storage of highly sensitive personal information through profiles, contact forms, invoice descriptions, or similar fields.

Please do not submit information such as:

  • Social Security numbers
  • Government identification numbers
  • Passwords
  • Bank account credentials
  • Payment card security codes
  • Medical or health records
  • Biometric information
  • Precise geolocation information
  • Information revealing account passwords or security credentials
  • Other highly sensitive information that is not necessary to use Olideck

11. Sensitive Personal Information, continued

Payment and financial information required by Stripe should be submitted directly through Stripe’s designated interfaces.

12. Data Retention

We retain personal information for as long as reasonably necessary to provide the Service and for legitimate business, legal, security, tax, accounting, fraud-prevention, and dispute-resolution purposes.

Retention periods vary depending on the type of information and why it was collected.

For example:

  • Account information may be retained while an account remains active and for an appropriate period afterward
  • Public profile information may be retained while the profile is active and for a limited period in backups after deletion
  • Invoice and transaction records may be retained as necessary for payment records, accounting, fraud prevention, disputes, legal compliance, or legitimate business records
  • Partner applications, referrals, commission adjustments, and payout records may be retained as necessary to administer the program, resolve disputes, prevent fraud, and meet tax, accounting, and legal obligations
  • Contact-form submissions may be retained as necessary to deliver, secure, troubleshoot, or document communications
  • Security and technical logs may be retained for reasonable periods to maintain the integrity and security of the Service

12. Data Retention, continued

Information may remain in encrypted backups or archival systems for a limited period after deletion from active systems.

Information delivered to an Olideck profile owner, invoice recipient, Stripe, or another independent third party may continue to be retained by that third party according to its own practices.

13. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction.

However, no internet transmission, storage system, software platform, or security measure can be guaranteed to be completely secure.

You are responsible for maintaining the security of your account credentials and promptly notifying us if you believe your Olideck account has been compromised.

14. Your Choices

Depending on how you use Olideck, you may be able to:

  • Update your account information
  • Modify or remove information from your public profile
  • Change your profile image
  • Modify services or pricing
  • Disconnect payment functionality
  • Close your account
  • Contact us regarding access, correction, or deletion of personal information

Certain information may be retained after an account is closed where necessary for legal, security, accounting, fraud-prevention, payment, or other legitimate purposes.

15. U.S. State Privacy Rights

Residents of certain U.S. states may have privacy rights under applicable law.

Depending on your jurisdiction and whether the applicable law applies to Merchard, LLC, these rights may include the right to:

  • Confirm whether we process your personal information
  • Access personal information we maintain about you
  • Obtain a portable copy of certain personal information
  • Correct inaccurate personal information
  • Request deletion of personal information
  • Opt out of certain sales of personal information
  • Opt out of certain sharing or targeted advertising
  • Limit certain uses of sensitive personal information
  • Opt out of certain profiling or automated decision-making activities
  • Appeal a decision we make regarding a privacy request

15. U.S. State Privacy Rights, continued

Because Olideck does not currently sell personal information or use personal information for targeted advertising as described above, certain statutory opt-out rights may not apply to our current practices.

15A. Exercising Your Rights

Please identify the request as a Privacy Request.

We may need to verify your identity before completing certain requests. Verification information will be used for the purpose of processing the request.

You may also authorize an agent to submit a request for you where applicable law permits. We may require evidence that the agent is authorized to act on your behalf.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

Some requests may be denied or limited where permitted by law, including where information must be retained for security, fraud prevention, legal compliance, contractual obligations, payment records, or establishment or defense of legal claims.

15B. Appeals

If applicable law gives you the right to appeal our decision regarding a privacy request, you may submit an appeal to support@olideck.com.

Include “Privacy Appeal” in the subject line and describe the request and decision you are appealing.

16. California Privacy Information

If the California Consumer Privacy Act, as amended (“CCPA”), applies to Merchard, LLC and your personal information, California residents may have rights including access, correction, deletion, portability, equal treatment, and the ability to limit or opt out of certain uses, sales, or sharing of personal information.

The categories of personal information we may collect are described in Section 2 of this Privacy Policy and may include:

  • Identifiers
  • Internet or electronic network activity
  • Commercial or transaction information
  • User-provided professional or business information
  • Customer records information
  • Profile images and other user-provided content
  • Other information you voluntarily provide

The sources, purposes, and categories of recipients of this information are described throughout this Privacy Policy.

Olideck does not currently sell personal information or share personal information for cross-context behavioral advertising.

Where required by applicable law, we will recognize applicable browser-based opt-out preference signals with respect to practices subject to such signals.

17. International Users

Merchard, LLC is a United States company, and Olideck is operated from the United States.

If you access Olideck from outside the United States, your information may be transferred to, stored in, or processed in the United States or other jurisdictions where our service providers operate.

Those jurisdictions may have data-protection laws that differ from the laws where you live.

Where required by applicable law, we will use appropriate safeguards for international transfers of personal information.

Residents of jurisdictions outside the United States may have additional privacy rights under applicable law.

You may contact support@olideck.com regarding applicable privacy rights.

18. Children

Olideck accounts are intended for individuals who are at least 18 years old.

The Service is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 through accounts intended for them.

If you believe a child under 13 has provided personal information to us in a manner covered by applicable children’s privacy law, contact us at support@olideck.com so that we can review and take appropriate action.

Olideck users should not intentionally use contact forms, invoices, or other Olideck functionality to collect children’s personal information in violation of applicable law.

19. Third-Party Websites and Services

Olideck may contain links to or integrations with third-party websites and services, including Stripe.

We are not responsible for the privacy, security, content, or practices of independent third parties.

You should review the privacy policies and terms of third-party services before providing information to them.

20. Email Communications

We use email to provide transactional and Service-related communications, including:

  • Account communications
  • Contact-form notifications
  • Invoices
  • Payment-related notifications
  • Security notices
  • Support responses
  • Important Service or policy updates

Certain emails are necessary to provide the Service and may not contain an unsubscribe option.

If we send marketing or promotional email, you may opt out of those communications using the unsubscribe mechanism provided or by contacting us.

Opting out of promotional email will not prevent us from sending necessary transactional, security, legal, or account-related communications.

21. Do Not Track

Some browsers provide “Do Not Track” signals.

There is not a uniform industry standard governing all uses of these signals.

Where applicable law requires recognition of a legally recognized browser-based privacy preference signal, we will process that signal as required by applicable law.

Because Olideck does not currently sell personal information or use it for cross-context behavioral advertising, such signals may not affect our current data practices.

22. Changes to This Privacy Policy

We may update this Privacy Policy from time to time as Olideck, applicable laws, or our data practices change.

When we update the Policy, we will revise the “Last Updated” date.

If changes materially affect how we use personal information, we may provide additional notice through the Service, by email, or by another reasonable method where required by law.

Your continued use of the Service after an updated Privacy Policy becomes effective is subject to the updated Policy.

Where applicable law requires consent to a material change, we will obtain consent as required.
